You hereby grant BlueFur an irrevocable, perpetual, non-exclusive, transferable, fully paid, worldwide license (with the right to sublicense) to (a) use, copy, publish, stream, store, retain, publicly perform or display, transmit, scan, reformat, modify, edit, frame, translate, excerpt, adapt, create derivative works and distribute (through multiple tiers), any User Content you (i) Post on or in connection with the BlueFur Service or the promotion thereof subject only to your privacy settings or (ii) enable a user to Post, including by offering a Share Link on your website and (b) to use your name, likeness and image for any purpose, including commercial or advertising, each of (a) and (b) on or in connection with the BlueFur Service or the promotion thereof.

I think that provision goes way too far. It alleges that people who comment on your blog grant a license to use their “name, likeness and image for any purpose, including commercial or advertising . . . .” If I add a comment to your blog, I assume the comment will remain on your blog for others to see but I don’t expect that I have authorized the blog owner to use my “name, likeness and image for any purpose, including commercial or advertising.”
Maybe you did not intend for this provision to apply to blog comments. Regardless, I think it goes way to far.

I now see the “April Fools Joke” title meta tag on this post. Good one. You had me going. It may not surprise you, but I’ve encountered provisions with similar language.

iii) And BlueFur agrees to assume all debts and obligations, without limit, held by or to be incurred by, the subscribers from the effective date of these changes.

Forget about the blog: this also includes the websites hosted on BlueFur’s servers! I don’t think I want my website’s content to be taken away so quickly and easily.
With that said, nicely done… and it’s easier on the eyes than YellowFur. ;-)

Heheheheheh! I read the post before reading the title, so it had me going for a bit there. On a more serious note though, one can never be too careful with the disclaimers and the fine print, as in today’s world, with lawyers and lawsuits lurking everywhere, there are very real dangers involved in not having your bases fully covered.

I was thinking about doing something similar on my blog for April fools but I was so busy I did not have any time to blog. First year I’ve missed it :(
